Terms of Service

These Terms of Service ("Terms") govern your use of WhispMe, a macOS application and related services operated by Arkt Labs Inc. ("we", "us", "our"), a company incorporated in Canada.

1. Acceptance of Terms

By downloading, installing, or using WhispMe, you agree to be bound by these Terms. If you do not agree, do not use the application.

2. Description of Service

WhispMe is a macOS application that converts voice recordings into text using AI-powered transcription. The service includes:

Voice recording and AI transcription
Text insertion into any text field on macOS
Cloud-based processing via our servers

3. Accounts and Registration

You must create an account to use WhispMe. You are responsible for maintaining the confidentiality of your account credentials. You must provide accurate information during registration.

4. Subscription Plans and Payment

WhispMe offers free and paid subscription plans. Paid plans are billed through Stripe. Prices are listed in USD.

Free: 5 minutes of transcription per calendar month, 1 device.
Plus: 5 hours per billing period, up to 3 devices.
Pro: 13 hours per billing period, up to 3 devices.

Subscriptions automatically renew unless cancelled before the end of the current billing period. You may cancel at any time through the app. Refunds are handled in accordance with applicable law.

5. Acceptable Use

You agree not to:

Use the service for any unlawful purpose
Attempt to reverse engineer, decompile, or disassemble the application
Share your account with others or exceed device limits
Transmit content that is illegal, harmful, or infringes on others' rights
Abuse the service in a way that degrades performance for other users

6. Intellectual Property

WhispMe and all associated trademarks, logos, and content are owned by Arkt Labs Inc. Your transcribed content remains your own property.

7. Privacy

Your use of WhispMe is also governed by our Privacy Policy. Audio recordings are processed for transcription and are not stored after processing is complete.

8. Disclaimers

WhispMe is provided "as is" without warranties of any kind. We do not guarantee that transcriptions will be 100% accurate. We are not liable for any errors in transcribed text.

9. Limitation of Liability

To the maximum extent permitted by law, Arkt Labs Inc. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of WhispMe. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your access to WhispMe at any time for violation of these Terms. You may stop using the service and delete your account at any time.

11. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes through the application. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of Canada. Any disputes shall be resolved in the courts of Canada.
